If you have applied for IHSS in California and received a denial for financial benefits, or you disagree with the amount of service hours given, you can appeal this decision. An appeal system known as a due process hearing can be used for parents or caregivers who have been denied IHSS. This process provides you with another chance to prove that your family qualifies for financial assistance.
However, you have only 90 days from the date of the Notice Of Action (NOA) to request your IHSS appeal. This includes filing a request for an appeal, gathering documentation and witnesses, and participating in a court hearing. The hearing will involve the presentation of evidence such as testimony by witnesses, letters from teachers/therapists/doctors, a log of activities and behaviors, and medical reports outlining the needs in the service categories where you and the county disagree.
We know what it takes to win your IHSS appeal to maximize the service hours you need. Our team has years of experience helping families just like yours receive the financial assistance they deserve.
